5228 sayılı kanunun 38’inci maddesi ile 13.07.1956 tarih ve 6802 sayılı Gider Vergileri Kanunu’nun Özel İletişim Vergisi başlıklı 39’uncu maddesi yeniden düzenlenmiştir. Anılan 39’uncu maddenin birinci fıkrasında; Telekomünikasyon Kurumuyla görev veya imtiyaz sözleşmesi imzalamak veya bu Kurumdan ruhsat veya genel izin almak suretiyle telekomünikasyon altyapısı kurup işleten veya telekomünikasyon hizmeti sunan işletmecilerin Kanun maddesinde belirtilen hizmetlerinin özel iletişim vergisine tabi olduğu, bu kişilerin özel iletişim vergisinin mükellefi olduğu, verginin matrahının katma değer vergisi matrahını oluşturan unsurlardan teşekkül edeceği ve katma değer vergisi matrahına dahil edilmeyeceği ve düzenlenecek faturalarda özel iletişim vergisinin ayrıca gösterileceği hükme bağlanmıştır. ÖTV mükelleflerinin durumu Telekomünikasyon Kurumuyla görev veya imtiyaz sözleşmesi imzalamak veya bu Kurumdan ruhsat veya genel izin almak suretiyle telekomünikasyon altyapısı kurup işleten veya telekomünikasyon hizmeti sunan ve özel iletişim vergisinin mükellefi olan işletmecilerinin fatura üzerinde gösterip tahsil ettikleri ve beyan ederek ödedikleri özel iletişim vergileri ile bu hizmetlerle ilgili olarak kendi adlarına düzenlenen faturalarda yer alan özel iletişim vergilerini, önceki bölümde yer alan madde hükmü uyarınca, gelir veya kurumlar vergisi uygulamasında matrahın tespitinde gider olarak dikkate almaları mümkün bulunmamaktadır. In the first paragraph of the said Article 39 it is stated that “ The services stated in the Law, provided by operators who establish and operate telecommunications infrastructure, or who provide telecommunications services through the conclusion of an assignment or concession agreement with the Telecommunications Authority, or who have obtained a license or general permission from the Telecommunications Authority, shall become subject to special communications tax, that such operators are special communications tax liables, that the items that constitute the tax base shall consist of the items that also constitute the value added tax base and shall not be separately be added up to the value added tax base, and that the special communications tax shall be disclosed separately on the invoices to be issued. . Corporation Tax Communiqué promulgated by the Ministry of Finance regulating this subject matter numbered 19 and dated 14.10.2005, contained explanations regarding whether or not the Special Communications Tax should be recorded as expense for purposes of income tax and corporation tax applications. The relevant explanations are provided in the ensuing sections. The Status of the Special Communications Tax Liables Whereas, pursuant to the above mentioned provision stating that For purposes of income tax and corporation tax applications … this tax cannot be recorded as expense and cannot be offset against any taxes”, the income and corporation tax liables shall not treat these taxes as expense in the determination of their tax assessment bases, and shall not be allowed to deduct this tax from the income and corporation burdens that they have calculated.
